A Notary Public is an official appointed by the state government—typically by the Secretary of State—to serve as an impartial witness during the signing of important documents. Their primary role is to help prevent fraud by verifying the identity of signers, confirming their willingness to sign without pressure, and ensuring they understand what they are signing.


Notaries are considered "ministerial officials," which means they must follow laws and guidelines exactly as written, without exercising personal judgment. This is different from a judicial officer, who may interpret or apply the law.


Notarial duties often include verifying signatures on critical documents such as:

  • • Real estate deeds and titles

  • • Wills and living trusts

  • • Powers of attorney

  • • Contracts and affidavits


In some cases, Notaries must also administer oaths or affirmations, requiring the signer to swear under penalty of perjury that the contents of a document are true.


A Notary must remain completely neutral and unbiased. They are prohibited from refusing service based on race, nationality, religion, political views, sexual orientation, or the person’s customer status.

A Notary Signing Agent (NSA) is a commissioned Notary who has received advanced training in managing and notarizing loan-related documents. They play a crucial role in the mortgage process by serving as the final step between the lender and the completion of the transaction. Typically working as independent contractors, NSAs ensure that borrowers correctly sign, notarize, and return their loan documents promptly. This step is essential for the loan to proceed to closing and for funds to be properly disbursed by the Title or Escrow company.

Florida law allows notaries to reasonably rely on valid identification that is current or issued within the past 5 years and contains a serial or identifying number. Acceptable forms of ID include:

Primary Forms of ID:

  • • Florida driver's license or state-issued ID card

  • • U.S. passport

  • • Foreign passport (must be stamped by U.S. Bureau of Citizenship and Immigration Services)

  • • Driver’s license or state ID issued by another U.S. state, U.S. territory, Canada, or Mexico

  • • Military ID issued by any branch of the U.S. Armed Forces

  • • Inmate ID issued by:

    • Florida Department of Corrections (on or after Jan. 1, 1991)

    • U.S. Department of Justice, Bureau of Prisons

  • • ID card from U.S. Bureau of Citizenship and Immigration Services

  • • Sworn law enforcement statement verifying identity of an inmate whose ID was confiscated

  If No ID is Available:

Florida law also allows alternative methods for those who cannot present valid ID, such as elderly persons, minors, or individuals with disabilities:

  1. One credible witness who is personally known to the notary

  2. Two credible witnesses who:

    • a) Present valid ID themselves

    • b) Personally know the signer

    • c) Swear that the signer cannot reasonably obtain acceptable ID

    • d) Have no financial interest or connection to the document being notarized

• Before your appointment, make sure your document is fully completed, leaving only the notarial section and signature lines blank.


• Carefully review the entire form to confirm that all names are spelled correctly and that dates are accurate.


• You’ll also need to bring a valid, unexpired form of identification with you at the time of signing, as this is required to complete the notarization.
